These Terms & Conditions govern your access to and use of Emric's website, mobile application, EV charging stations, software platforms, and related services operated by Airace Technologies Private Limited (“Airace”, “Emric”, “we”, “our”, or “us”).
By using Emric services, you agree to comply with these terms. If you do not agree, please do not access or use our services.
Eligibility
You must be at least 18 years old or legally authorized under applicable laws to use Emric services and charging infrastructure. By creating an account, you confirm that you meet this requirement.
Use of Services
Emric grants you a limited, non-exclusive, non-transferable right to access and use our services for personal or commercial EV charging purposes.
- You must use charging stations responsibly and safely.
- You must not misuse, tamper with, or damage charging infrastructure.
- You may not attempt unauthorized access to Emric systems or networks.
- Reverse engineering, decompiling, or copying Emric software is prohibited.
- You may not use the platform for fraudulent or unlawful purposes.
Accounts & Registration
Some services require account registration via email, phone number, Google, or Apple sign-in. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
Please notify us immediately if you suspect unauthorized access to your account.
Payments, Wallet & Billing
Charging fees, wallet top-ups, subscriptions, and related payments are subject to applicable pricing displayed through Emric platforms. All transactions are processed in Indian Rupees (INR) unless otherwise specified.
By using paid services, you authorize Emric and its payment partners to process transactions associated with your usage. Wallet credits are non-refundable except as required by applicable law or at Emric's sole discretion.
Charging Sessions
Charging sessions are initiated via QR code scan or manual entry through the Emric app. You are responsible for ensuring your EV is properly connected before and during a session. Emric is not liable for any damage arising from improper use of charging equipment.
Sessions are billed based on energy consumed (kWh) or time, as displayed in the app at the time of use. Emric reserves the right to update pricing with prior notice.
Availability of Services
Emric strives to maintain reliable charging infrastructure and digital services. However, uninterrupted availability cannot be guaranteed due to maintenance, technical issues, power interruptions, network outages, or other external factors beyond our control.
Intellectual Property
All Emric branding, software, content, designs, trademarks, charging technology, and digital assets are the exclusive property of Airace Technologies Private Limited.
Unauthorized reproduction, distribution, or commercial use of any Emric intellectual property is strictly prohibited.
Host Responsibilities
If you use Emric services as a charging host (installing and operating chargers on your premises), you agree to:
- Maintain charger accessibility and safety standards.
- Ensure proper electrical infrastructure at your location.
- Comply with all applicable local laws and regulations.
- Accurately represent your location and charger availability.
Third-Party Services
Emric services may integrate with third-party payment gateways, mapping services, analytics tools, WhatsApp Business API, and external providers. Emric is not responsible for third-party platform availability, policies, or data practices.
Limitation of Liability
To the maximum extent permitted by law, Airace Technologies Private Limited shall not be liable for indirect, incidental, special, or consequential damages arising from the use or inability to use our services or charging infrastructure.
Users access and use Emric services at their own discretion and risk.
Suspension & Termination
Emric reserves the right to suspend or terminate access to services in cases involving misuse, fraudulent activity, violations of applicable laws, or breaches of these Terms.
Privacy
Your use of Emric services is also governed by our Privacy Policy and App Privacy Policy.
Changes to Terms
Emric may update these Terms & Conditions periodically. Continued use of services after updates constitutes acceptance of the revised terms. We will notify users of material changes via the app or email.
Governing Law
These Terms shall be governed by and interpreted under the laws of India. Any disputes shall fall under the exclusive jurisdiction of courts located in Bengaluru, Karnataka.
